Sex Offences
Being convicted of a sexual penetration offence will nearly always see you sentenced to immediate prison. That is why it is important to seek legal advice if you are questioned or charged by police for a sex related allegation.
Sexual penetration trials involving adults typically fall into two categories:
-the accused person denies the sexual penetration happened at all; OR
-the accused person agrees there was sexual penetration but says it was consensual.
Where a sexually themed act is alleged, but there has been no penetration, the law deems this to be an indecent assault. Indecency is defined as being an act that offends common propriety. An example would be the grabbing of a person’s private parts.
